5. Restrictions on Use
5.1. Modify, download, reproduce, copy, or resell any material featured on the website, its content, or any other service offered by EduTakers.
5.2. Commercially use the services, the website, the content, or any derivative thereof.
5.3. Bypass any measure put in place to prevent or restrict access to any portion of the website or any other service operated, owned, and managed by EduTakers.
5.4. Interfere with or damage the operation of the website in any way, including uploading viruses, adware, spyware, worms, or other malicious code.
5.5. Use any robot, spider, data miner, crawler, scraper, or other automated means to access the website to collect information from or otherwise interact with it.

5.16. Upload, post, transmit, or otherwise make available any unsolicited offers, advertisements, proposals, junk mail, or spam to other users of the website.
5.17. Upload, post, transmit, share, store, or otherwise make publicly available any private information of any third party.
5.18. Solicit personal information from anyone under 18 or solicit passwords or personal information for commercial or unlawful purposes.
5.19. Upload, post, transmit, share, store, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
5.20. Upload, post, transmit, share, store, or otherwise make available content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or create liability or violate any local, state, national, or international law.
5.21. Upload, post, transmit, share, store, or otherwise make available content that, in the sole judgment of EduTakers, is objectionable or which restricts or inhibits any other person from using or enjoying the website or any related service, or which may expose EduTakers or its users to any harm or liability of any type.
6. Membership
6.1. Registration: A portion of the content on the EduTakers website is available for free viewing without requiring any form of membership.
6.2. Access to Additional Content: To access additional content, you will need to register as a member (“Member”) with the website and purchase a membership (“Membership”). EduTakers grants Members a license to access certain content on the website, depending on the precise terms of their Membership (see below).
6.3. Providing Information: During registration, you will be required to provide certain information, including your full name and email address.
6.4. Accuracy of Information: The information you provide must be true, accurate, current, and complete. If the information provided upon initial sign-up changes after this time, it is your obligation to update and correct it. If any information provided by you is not true, accurate, current, or complete, EduTakers reserves the right to terminate your Membership and refuse any current or future access or use of the website.
6.5. Password Security: When selecting a password, for your own security, you should choose a combination of lowercase, uppercase, numbers, and symbols (e.g., bridge-39-BOOK). Please ensure you select a password unique to your EduTakers account. Avoid choosing obvious words or dates such as a nickname or your birth date. Please exercise maximum caution to keep your username and password confidential and log off from the website when your session is complete to prevent unauthorized access to your information. If your username or password is subject to unauthorized access, you should immediately inform EduTakers.
6.6. Confirmation of Membership: Once EduTakers has received your information, you will be sent a confirmation email confirming that you are a Member of the website. You will have your own Member’s account, with an account management page, which will contain details of any Membership(s) that you have purchased and your account settings.
6.7. Security Measures: For security purposes, each Member’s account can only be accessed on one device at a time. As explained in clause 6.15.2 below, we monitor all Members’ usage of the website and do not permit Members to share their login details. If you have been logged out of your account, please check that you are not logged in on any other device and that you have not shared your login details with anyone else.
6.7A. Device Limitation: You can access the website from a maximum of five devices within a 30-day period. If you exceed this number, your account may be terminated.
7. Charges and Payment
7.1. Subscription Requirement: To access the members’ section of EduTakers, a user must purchase a Membership on a recurring payment basis (“Subscription(s)”).
7.2. Changes to Charges and Payments: EduTakers reserves the right to make any changes at any time to the amount, structure, or timing of any charges and/or payments for any of the services.
7.3. Billing Cycle: You will be billed in advance on a recurring and periodic basis (referred to as a “Billing Cycle”). Billing Cycles are set either on a monthly, three-monthly, annual, or biennial basis, depending on the type of subscription plan you select when purchasing a Subscription.
7.4. Subscription Renewal: At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or unless EduTakers cancels it. You may cancel your Subscription renewal either through your account management page or by contacting EduTakers’ customer support team.
7.5. Payment Method: A valid payment method, including credit card or debit card, is required to process the payment for your Subscription. You shall provide EduTakers with accurate and complete billing information, including your full name and details of a valid payment method. By submitting such payment information, you automatically authorize EduTakers to charge all Subscription fees incurred through your account to any such payment instruments.
8. Termination and Suspension
8.1. Termination or Suspension by EduTakers: EduTakers may terminate or suspend, with immediate effect and without notice, your access to and use of the services as a Member, for any reason, particularly if:
- Payment is not received;
- EduTakers believes you have shared your account with another student, person, or entity (EduTakers is able to monitor your usage of the service and will use this information to draw a conclusion as to whether you have shared your account details);
- EduTakers believes that you have logged into the website on more than five devices within a given 30-day period;
- EduTakers believes you have breached any of the Terms of Service;
- EduTakers is unable to verify the accuracy or validity of any information provided by you; or
- EduTakers suspects fraudulent, abusive, or illegal activity by you.
8.2. Discretion of EduTakers: EduTakers may come to a conclusion that results in termination or suspension, even if it is based upon our opinion or mere suspicion or belief, without any duty to prove that our opinion or suspicion is well-founded and even if our opinion or suspicion proves not to be well-founded.
8.3. Unsuitable Conduct: At any point, if EduTakers deems user conduct to be unsuitable, the Company may, of its own volition, choose to terminate any license or permission previously granted to a user.
8.4. Cancellation by User: You may cancel your Membership at any time, but under no circumstances will EduTakers provide a refund of any payment(s) (see clause 12 below).
9. Third Parties
9.1. Association: EduTakers is not associated with, nor an agent of, any third party, including any party named or linked on the website, and therefore does not have any authority regarding such third parties.
9.2. Jurisdiction and Liability: EduTakers maintains no jurisdiction over, endorsement of, responsibility for, or liability for any content, products, advertising, or other resources available from any third party.
9.3. Dispute Resolution: By agreeing to the Terms of Service, you agree that EduTakers (and our officers, directors, and employees) have no liability to you in relation to any dispute you may have with any third party.
9.4. Independence from Exam Boards: EduTakers is a private company and acts solely and entirely independently from any exam board, including any exam board mentioned on the website. EduTakers and the exam boards (whether or not mentioned on the website) share no formal contract, affiliation, endorsement, or association with each other. In no way do any of the exam boards manage, check, or engage in any quality control regarding any of the services, including any content available on the website. As explained in clause 4 above, reliance on the services, including any information appearing on the website, is strictly at your own risk.
10. Copyright
10.1. Protection of Content: By agreeing to the Terms of Service, you acknowledge that all the content and information provided on the EduTakers website and/or through the services, or contained in any advertisements, sponsorships, or presented to you by EduTakers, is protected by relevant copyrights, trademarks, service marks, patents, or other proprietary rights and laws. You will not copy, reproduce, modify, adapt, translate, transmit, distribute, reverse engineer, decompile, or disassemble any aspect of the services or the website.
11. Limitation of Liability
11.1. Exclusion: To the maximum extent permitted by law, EduTakers disclaims all liability for any loss or damage whatsoever arising out of, or in connection with, the use of the website, services, or any information contained on the website or provided through the services.
11.2. Liability Exemption: This includes, but is not limited to, any direct, indirect, special, punitive, or consequential damages, loss of data, income, or profit, loss of or damage to property, or claims of third parties, even if EduTakers has been advised of the possibility of such loss or damage.
12. Refunds
12.1. Non-refundable Nature: All payments made to EduTakers, whether on a one-time or recurring basis, are strictly non-refundable.
12.2. No Exceptions: There are no exceptions to this policy, including for Memberships cancelled before the end of the relevant Billing Cycle.
13. Indemnification
13.1. Protection: By agreeing to the Terms of Service, you agree to indemnify, defend, and hold harmless EduTakers and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, expenses, damages, and losses, including legal fees, resulting from any violation of these Terms of Service or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the website using your account.
14. Governing Law
14.1. Choice of Law: These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales.
14.2. Jurisdiction: Any dispute arising under these Terms of Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Severability
15.1. Interpretation: If any provision of these Terms of Service is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms of Service shall remain in full force and effect.
16. Entire Agreement
16.1. Superdense: These Terms of Service constitute the entire agreement between you and EduTakers regarding your use of the website and the services, superseding any prior agreements between you and EduTakers relating to your use of the website and the services.
16.2. No Waiver: The failure of EduTakers to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
16.3. Amendment: These Terms of Service may only be amended by a written document signed by both parties or by EduTakers posting revised Terms of Service on the website.
